IAM-UAL Agreement

- Company physician, Dr. Jensen, and Ms. [employee's name omitted]'s
physician will select a third impartial qualified physician to review
Ms. Lee's medical records as of Feb. 1997. The purpose of this review
is to determine Ms. Lee's medical fitness to perform the regular duties
of the Ramp Serviceman at that point in time including, but not limited
to her ability to lift up to 70lbs. The medical records to be reviewed
will include the Company's medical records, and the medical records
of Ms. Lee's treating and examining physicians, including South Coast
Orthopaedic and Dr. Zaccharia.
- The expense of the third doctor review shall be borne 1/2 by
Ms. [omitted] and 1/2 by the Company.
- If the impartial qualified physician determines that Ms. [omitted]
was medically fit to perform the regular duties of a Ramp Servceman
in Feb. 1997, she will be allowed to return to service only after being
cleared by Untied Medical following a FCE, without loss of seniority.
- Notwithstanding the determination of the third party impartial
qualified physician, the Company will have no liability for any back pay or
additional medical expenses except those described in par. 2 above.
- This settlement is agreed upon based on circumstances unique to this
specific situation. Both the Company and Union agree this settlement is
reached without setting a precedent, and without prejudice to any past,
present or future grievance, and will not be cited by either party in
cases other than those involving the grievant.
----------- I understand and voluntarily accept the above terms of
settlement and my acceptance constitutes a full and final resolution
of this matter. I unconditionally release the Company and all related
corporations and any agent or employee thereof, as well as the Union,
from all claims, legal actions, damages and liabilities whatsover,
whether know or unknown, arising out of or in any way related to this
matter up to the date of signing of this agreement.
